An ex-Morgan Stanley banker busted for video-recording sex romps with three women recently friend-requested one of them on Facebook, prosecutors charged Thursday in court.
The friending offer could be in violation of an order of protection the woman had against John C. Kelly if it was made after charges were brought against him.
Prosecutors are working to obtain Facebook records to see if that's the case.
In the meantime, the disgraced son of reputable civil attorney John Q. Kelly agreed to take his page down while his case plays out in Manhattan Supreme Court.
Kelly's attorney Sarita Kedia called the Facebook request an "inadvertent request," noting that similar allegations were made by prosecutors within the last year.
"It wasn't something the defendant intentionally did. Maybe it was a friend request that was made before [he was charged]," Kedia said.
Kedia also said it was "simply silly" the victims didn't know Kelly, 32, was filming them because in some instances, he was holding his iPhone in his hand during the trysts.
"I think that any normal, intelligent person seeing a person holding an iPhone in their hand during an encounter like this would understand what the purpose was and probably see it," she said.
