The Beanie Babies creator has turned into a cry baby.
Ty Warner, who in October admitted to stashing as much as $107 million in a Swiss bank account to evade taxes, has asked a Chicago judge to keep him out of prison.
The 69-year-old executive wants probation.
Warner, scheduled to be sentenced on Jan. 14, faces a prison term of 46 to 57 months.
In October, when admitting guilt, he cried in front of the judge.
Warner, who owns New York City's Four Seasons Hotel, told the judge he merits leniency because he has paid a $53 million penalty, at least $16 million in back taxes and interest — and because he overcame a tough childhood.
"Ty emerged from an unhappy family and a youth devoid of educational advantages to become, through decades of hard work and extraordinary creativity, a self-made American success story," Warner's defense team said in a court filing.
"He conceived of and delivered an affordable, highly desirable product that brought joy and comfort to millions of children," they wrote.
And he describes his decision to illegally avoid taxes a "terrible mistake" — and blames his Swiss financial advisers for talking him into the move.
Warner created and opened his Swiss accounts in 1996.
The accounts helped him sidestep $5.5 million in taxes, according to federal authorities.
Warner is one of more than 100 people nabbed by the feds over the past five years for tax evasion using the same scam.
