An Upper East Side couple says their super was a regular Tin Man — he didn't have a heart.
Attorneys Patrick Hayes and Carmen Pacheco are suing the building superintendent for allegedly ignoring a fire that started in their East 62nd Street building — and the yipping pleas of their treasured terrier Toto Love, who died in the burning apartment.
The couple "were shocked to learn" that Nazim Taipovic at first "heard Toto barking several times and ignored said barks knowing Toto was a quiet and loving cairn terrier," the Manhattan Supreme Court suit alleges. When he later opened the door to the apartment to investigate the fire, he slammed it shut when smoke came pouring out, trapping Toto inside, the suit says.

The couple was not home at the time.
Toto, who was 16, is the same breed as his silver-screen namesake in the "Wizard of Oz." Taipovic knew Toto because he'd cared for him when his owners were away in the past, the couple claim. But last July when the fire started he was doing a side job painting another resident's apartment.An electrical fire started in the walls behind the first-floor apartment. A fire captain tried to revive the pooch with CPR for 15 minutes, Pacheco told the Post. "He was really an integral part of the family," a devastated Pacheco said.
"He was just an amazing dog in affection and just being there for you," her husband added. "He was my BFF."
The suit also blames the building's management company, Akam Associates, for a disabled fire alarm and its security service Winfield Corp., for not acting to save Toto. None of the defendants returned calls for comment.
